摘要
南非的劳动合同法律制度汲取了欧美法律的精华,同时又极具本土特色。南非劳动合同的形式、内容和类型的规定都倾向于对雇员权益的保护,雇主如果在雇佣和解雇雇员时没有遵循南非劳动合同法律制度的规定,可能会遭受不利影响和严重的经济损失。比较中南两国劳动合同法律制度的不同,可给予我国的驻南非企业和外国劳动法研究一定的借鉴和启示。
South Africa’s labor contract law system absorbs the essence of the law of Europe and the United States, andat the same time it has the local characteristics extremely. The form, content and type of the labor contract tend to protectthe rights and the interests of employees, and thus if employers did not follow the provisions of the labor contract law systemin hiring and firing employees of South Africa, he may suffer negative influence and serious economic loss. Comparingthe difference between Chinese labor contract law system and South Africa labor contract law system will give someenlightenment to the companies in South Africa and the research of foreign labor law.
