论渎职犯罪中“原案”的三个基本问题

On the Three Fundamentals of the "Original Bill" in the Crime of Dereliction of Duty

渎职罪的原案指的是相关渎职罪成立所依赖的,被相关程序所认定的独立存在的其他案件。存在"原案"的渎职罪罪名的犯罪构成各不相同,离开具体个罪的犯罪构成抽象地去谈"原案"的性质并不可取。"原案"一般情况下应当作为定罪情节,但是"原案"的内容多样,在某一部分的内容能够满足定罪的前提下,剩余的内容应当转化为量刑情节,从而对本罪的量刑产生影响。在实体处理上,应当紧扣原案和本案的性质及其内在联系,把"原案"作为渎职犯罪的犯罪对象,才能准确认定渎职犯罪。

The original bills refers to what the establishment of the crime of duty dereliction relies on but are affirmed asseparate independent cases by related procedures. The constituents of the crime that has an 'original bill' vary,so it isundesirable to discuss the nature of the 'original bill' without considering a particular crime's constituents. In general,the 'original bills' are seen as circumstances for adjudgement,but as their contents are different,when part of the con-tent satisfies conviction,the rest is used as circumstance for sentencing. In practice,the crime of dereliction of duty canonly be accurately affirmed by grasping the nature of the original bill and the case as well as their internal connections,and treat the original bill as the object of the crime.
