摘要
在公用事业PPP和规制改革中,消费者利益如何被代表是决定改革正当性的一个核心问题。作为行业性消费者代表机构的制度典型,英国2000年《公用事业法》设立的燃气与电力消费者委员会,是一个独立、法定、专业的消费者代表机构,并被赋予一系列与其监督功能相适应的法定权力,使之能够与监管机构、供应企业相制衡而成为消费者的强力代言人。这一制度设计为我国PPP与公用事业规制的未来制度构建提供了可能的经验。
In the reform of public utilities PPP and regulation#how consumers?interests arerepresented is a core issue of the legitimacy of the reform.As a typical institutional model of theindustrial consumer representative offices#the Gas and Electricity Consumer Council,establishedaccording to^Public Utilities Law%in Britain#2000#is an independent#legal and professionalconsumer representative office#and endowed with a series of legal powers to adapt to its supervisoryfunction#so that it can become a strong advocate for consumers with the regulatory agenciesand the supply enterprises.This institutional design provides possible experience for the futuresystem construction of PPP and public utility regulation in China.
