PPP中政府多重角色冲突及其化解的法律机制研究——以公用事业特许经营为例

On Legal Mechanism of Conflict of Multiple Government Roles and its Resolution in PPP Model

政府与社会资本合作(PPP)不仅是一种管理工具,更是一种社会治理的基本战略。政府及其职能部门在PPP项目的每个阶段都具有不同的法定职责权限,在分类总结的基础上,可将政府角色界定为宏观调控者和规则制定者、中观监管者、微观授权者与合作者以及公共利益代表者。但是,PPP中政府多重角色存在着大量的冲突,主要表现为角色自身内在的冲突、宏观调控者与公共利益代表者之间的冲突、规则制定者与监管者之间的冲突、监管者与合作者之间的冲突等。PPP中政府多重角色冲突的化解需要完善的制度保障、相对独立的政府机构角色定位、有效的政府机构协调机制和多元的合作治理机制。

The PPP model is not only a management tool,but also the basic strategy of socialgovernance.The government and its functional departments have different in different stages.On the basis of the classification summary,the roles are defined as the macro regulator and the regulation maker,the micro,the medium regulator,and the representative of public interests.But there are manyconflicts among the different roles,such as the internal conflict in the role itself,the the macro regulator and the representative of public interests.the conflict between the regulationmaker and the medium regulator,the conflict between the medium regulator,and so on.The resolving mechanism of the roles conflict in the PPP needs perfect systems,relatively independent government agencies,effective government coordination mechanism,and multiple cooperative governance mechanism.
