基于中美清洁煤技术科技计划与法律制度研究对两国差异进行对比分析。以环保和经济发展为出发点,美国清洁煤技术科技计划多由政府和企业联合层层推进技术逐级发展,涉及技术研发、示范以及商业化等全过程,配有完备的法律事务体系及完善的政策,国际热点碳捕集、利用与封存亦如此,商业化应用走在世界前列;中国清洁煤技术科技计划着重于全面推进各项技术的发展,急需落实具体的推动措施并加强对地区强制性执行硬性标准的齐全构建,形成专业的法律事务体系与配套政策,驱动煤炭高效清洁利用。

This paper analyzes the differences between the two countries based on China-US Clean CoalTechnology of Science and Technology Program and Legal Institution Research.Taking the environmentalprotection and economic development as the starting point,the US Clean Coal Technology and TechnologyProgram is developed by the government and the private sector at all levels to promote the progressivedevelopment of technology,involving technology research and development,demonstration andcommercialization of the whole process,with a comprehensive legal affairs system and perfect policy,and forthe international hot-Carbon Capture,Utilization and Storage,whose commercial applications ranked first inthe world.China’s Clean Coal Technology Program focuses on comprehensively promoting the developmentof various technologies.It is imperative to implement concrete measures to promote the implementation ofmandatory standards and to form a professional legal system and supporting policies to drive coal for highefficient and clean utilization.
