近几年,开源在ICT产业发展中起到越来越重要的作用。开源是一种独特的开发模式、产权模式,且两者密切相关。本文首先对开源的开发模式进行研究,理解开源社区运作、开源项目开发模式,是分析开源知识产权问题的前提。在开源知识产权问题研究方面,本文围绕开源许可协议,主要分析开源软件的著作权、专利问题。最后,本文总结了开源企业知识产权保护方面面临的问题,并提出企业规避知识产权风险的策略。

In recent years, open source has played an increasingly important role in the development of ICT industry. Open Source is a unique development model as well as property rights model. In this article, the development model of open source is studied firstly. Understanding the operation of open source community and the development of open source project is the premise of studying open source intellectual property issues. The article mainly analyzes the copyright and patent issues of open source. Finally, this article summarizes the IPR problems of open- source enterprise, and puts forward the strategy ofenterprises to avoid intellectual property risks.
