地方政府重大行政决策合法性审查主体改革--以政府法律顾问制度为背景

The Reform on the Legal Examination Subject of Major Administrative Decision Making from Local Governments

相较于目前实践中重大行政决策合法性审查主体设置的主流模式政府法制机构模式而言,政府法律顾问模式的价值不只体现在合法性审查机构的名称改变上,而且更能保障政府法律顾问在履行合法性审查职责时可以充分享有足够的独立性、科学性和权威性。政府法律顾问在履行职责时除了应坚持独立审查和书面审查原则,还应将合法性审查意见本身排除在法律责任追究情形之外。

Compared with the government legal organization mode, the dominating mode of majoradministrative decision making subject setting in practice, the value of government legal adviser mode lies innot only the alteration of the name of the examination organization, but also in the sufficient independence,science and authority from the government legal adviser when performing the duties of legal examination. Inaddition to adhering to the principles of independence examination and written examination, the governmentlegal adviser should also exclude legal examination opinions to the case of legal liability.
