民间借贷的犯罪性异化预防——以律师介入为视角

Criminal Alienation Prevention of Private Lending——from the Perspective of Lawyer Intervention

活跃的民间借贷,一方面为我国经济的繁荣发展做出了卓越的贡献,但另一方面因为法律规制的缺位、监管体系的缺乏和风险控制意识薄弱等原因,民间借贷犯罪性异化屡见不鲜,严重扰乱了我国的金融管理秩序。为了预防民间借贷犯罪性异化,促进民间借贷有序、良性开展,应当在政府主导下,律师全方位地介入民间借贷。

On the one hand, private lending activity has made outstanding contributions to the prosperity and development of China's economy. On the other hand, because of the absence of legal supervision system and the lack of risk control awareness, private lending crime alienation often appears, which seriously disturbed in our country, the order of financial management. In order to prevent the alienation of private lending crime, promoting private lending orderly, and benign development, should be involved on all aspects of private lending by lawyers under the leadership of the government.
