网上立案与诉权保障

The Case Registration Online and Protection of Civil Right of Action

网上立案是最高人民法院在本轮司法改革中推出的一种立案程序,是电子司法的重要组成部分。网上立案切实减轻了当事人的诉累,对于当事人诉权的保障具有积极意义。但在司法实践当中,网上立案存在名实不副、对基层人民法院重视程度不够、与现行民事诉讼法具体规定存在冲突等问题,由此网上立案程序需通过完善网上立案平台及配套服务、处理好与现行立法的衔接、转变当事人诉讼观念等举措,从而保障当事人诉权的实现。

The case registration online is a filing procedure launched during the current round of judicial reform in Supreme People’s Court,it’s an important part of electronic justice.The case registration online effectively reduces the litigation of the parties concerned,which has a positive meaning for the parties to protect the rights of action.However,there are still some problems existed in the judicial practice,such as the case registration online is not true,the grassroots people’s court isn’t got enough attention,and the existing provisions of the civil procedure law conflicts and other issues.Therefore,the case registration procedures online need to improve the online registration platform and supporting services,make good convergence with the current legislation,change the litigation ideas and other initiatives,in order to protect the realization of the parties’litigation rights.
