从制度反腐看国家监察委员会的设立

On the Establishment of National Supervisory Commission from the Perspective of Institutional Anti-Corruption

强化党内监督与推进监察体制改革,是当前制度反腐的两个重要支柱。中共中央办公厅于2016年11月7日印发了《关于在北京市、山西省、浙江省开展国家监察体制改革试点方案》,通过在试点地区设立监察委员会为全国范围内的监察体制改革积累经验,拉开了国家监察体制改革的帷幕。国家监察委员会的创建对我国的监察体制改革和制度反腐具有重要意义,同时国家监察委员会的合宪性问题、自身监督问题、与检察院的职能衔接问题等也有待从法理上得以解决,值得进一步探讨。

The reinforcement of inner-party supervision and the promotion of the reform of the supervision system are two important mainstay for current institutional anti-corruption.On November7th2016,the Pilot Project Scheme on Carrying out the Reform of National Supervision System in Beijing Municipality,Shanxi Province and Zhejiang Province was issued by the General Office of the CPC Central Committee,which opens up the reform of national supervision system through the establishment of the supervisory commission in the areas of pilot project for the experience accumulation of the nationwide reform of supervision system.Although the establishment of National Supervisory Commission is of great significance to China’s reform of supervision system,the problems of its constitutionality,its self-supervision and its functional connection with procuratorate have not yet been solved jurisprudentially,which is worth being further discussed.
