公安机关交通事故认定的现状、问题与对策

Status Quo, Problems and Countermeasures of Differentiating Traffic Accident Responsibilities for Public Security Organs

交通事故责任认定是事故处理的重要环节,其准确性直接关系到相关当事人的法律责任。公安机关认定交通事故的法律依据经历了多次演变。在常规事故处理与认定中,因当事人原因或事故处理人员素质能力与责任心的欠缺,致使适用简易程序处理的交通事故认定风险更大。目前公安机关在交通事故认定人员、认定规则、认定机制、认定纠纷上均存在不足之处,容易导致错误的认定。应当从提升人员素质、细化认定规则、强化责任追究、建立再审认定等角度防范认定风险。

Differentiating traffic accident responsibility is an important part of traffic accident handling,and its accuracy is directly related to the legal liability of the relevant parties.The legal basis for public security organs handling traffic accidents has been changed many times.Due to the reasons of the parties or the accident handler,there is a big risk by using summary procedures to deal with traffic accidents.At present,there are such corresponding problems as follows:the traffic accident differentiating personnel,differentiating rules,differentiating mechanism,differentiating dispute,which easily lead to the wrong identification.Such countermeasures should be adopted to avoid identified risk by improving the quality of personnel,refining the rules,strengthening the accountability and establishing the retrial mechanism.
