代孕中亲子关系认定规则的路径探析

A Discussion on Path of Parenthood Cognizance Rules in the Case of Surrogacy

代孕中亲子关系的认定是无法回避的现实问题,但是缺乏相关法律规定。学界对此问题分歧颇大,主要有四种观点,即血缘说、分娩说、契约说、子女利益最佳说。为了更好地解决代孕中亲子关系的认定问题,应坚持"分娩说"优先的同时,兼顾子女利益最佳原则。

The parenthood cognizance is an unavoidable question of reality in the case of surrogacy.However,there is no related law.There is noticeable disagreement with regard to this question,and four opinions prevail,including the discourse of blood relationship,the discourse of delivery,the discourse of contract and the discourse of best interest of children.To solve the problem with parenthood cognizance rules in the case of surrogacy,the“discourse of delivery”should be put in the first place,with discourse of best interest of children taken into consideration.
