虚假诉讼已经严重影响了国家的社会诚信,立案登记制带来案件增多的同时也让虚假诉讼问题更加突出,但立案登记制的确立不仅不应是虚假诉讼爆发的助推器,相反人们可以通过分析立案登记制后虚假诉讼发生的主要原因,以及其所导致的危害,以理论为起点结合实证数据,从成本与收益的经济角度,程序安定与司法威信的社会角度,有针对性地提出预防虚假诉讼的对策。

The False litigation has seriously affected the social integrity of our country.The establishment of a registration system should not only be a booster for the outbreak of false litigation.On the contrary we can harm through the analysis of the main reason for the occurrence of false litigation filing registration system and produces,from the cost and income of the economic point of view,the procedure stability and the judicial authority and society,put forward the countermeasures to prevent the false lawsuit.
