医疗机构在依法管理中的若干思考

Certain rethinking on the management by law of medical institutions

推进健康中国战略需要不断深化医药卫生体制改革,特别是公立医院的改革,而建立现代化医院管理制度是公立医院改革的重要切入点。在依法治国的背景之下,法治应该成为现代化医院管理方式的基本要素。文章以文献研究和文本分析为主要方法,进行管理学和法学在医院管理场境中的交叉研究,就依法管理医院这一问题从概念、原因、依据、路径4个方面进行了详细论述,倡导加强法制医院建设,提出构建法治医院需要在法律人才、法务工作和法治文化等多个层面有序开展和长期夯实,从而为现代化医院管理制度的建成提供有力支撑。

The medical and health system reform,especially the reform of public hospitals,should be unceasingly deepened to push ahead with the strategy of Healthy China,and building a modern hospital management system is an important breakthrough point for the reform of public hospitals.Under the background of rule of law,the rule of law should be an essential factor of modern hospital management mode.Mainly using the methods of literature study and text analysis,the paper conducts cross-over study on the sciences of management and law in the context of hospital management,elaborates the concept,reasons,bases,and approaches of hospital management by law,and proposes to strengthen the legal system construction of hospital.To establish a hospital under the rule of law,efforts should be orderly made and consolidated for a long term on multiple aspects,i.e.,legal talent,legal work,and the culture of rule of law,thus providing strong support for the establishment of modern hospital management system.
