论警察管制的正当性

警察管制有着深厚的法律基础、理论基础和社会基础。现行法律对警察机关警察管制权、警察管制范围、警察管制手段有着明确授权,为其解决了形式上的合法性;意识形态领域内的公民权利限制正当性理论、政府管制理论、公共利益理论、风险社会理论为其提供充分的理论支撑。我国社会转型时期许多治安风险得以产生的根源性因素,以及直接依赖警察管制予以消除的不和谐社会现象的广泛存在,是警察管制赖以存续的现实基础,也是警察管制实质正当性的渊源。因此,警察管制的正当性不容置疑。

Police regulation has deep legal basis,theoretical basis and social basis.Firstly,the current lawhas a clear mandate for police power,range and means,which accounts for the formal legitimacy of policeregulation.Secondly,the theory of legitimacy of civil rights restriction provides sufficient theoretical supportto the police regulation,so do the theory of government regulation,the theory of public interest,and thetheory of risk society in the field of ideology.Thirdly,the root causes of many public security risks during theperiod of social transformation in our country and the widespread existence of the phenomenon ofdisharmonious society,which is directly dependent on the police regulation to eliminate it,are the realisticbasis for the existence of police regulation and the origin of the legitimacy of police regulation.So,thelegitimacy of police regulation is undeniable.
