公安机关负责人赔礼道歉制度研究

Research on the Apology System of the Head of the Public Security Organ

现行法律规范中,对公安机关负责人赔礼道歉适用于《国家赔偿法》、《治安管理处罚条例》等外部行为(侵害行政和刑事司法程序),(涉众服务类)授益行政和公安机关内部行政尚未有涉及。公安机关负责人赔礼道歉制度的启动事由、道歉主体、道歉对象、道歉形式、道歉方式、道歉程序均未有明文规定,导致警务实践中无法可依,亟待立法规范。

In the existing legal norms,the apology system of the head of public security organ is applicable inthe State Compensation Law,Regulation on Administrative Penalties for Public Security and so on,but notapplicable in beneficial administration and internal administration of public security organs.Currently,thesystem is not consummate lacking of explicit regulation about the startup,subject,object,form,methods andprocedure,which needs to be completed in legislation.
