跨国公司社会责任的确立:基于横向人权义务的补充分析

Establishing the social responsibility of transnational corporations: A complementary analysis based on horizontal human rights obligations

已有研究虽为确立跨国公司的社会责任奠定了某种理论基础,但都存在诸多不足。从横向义务的角度来分析跨国公司社会责任,可以为确立跨国公司社会责任提供一种补充性的理论框架。在横向人权义务视角下,跨国公司社会责任的义务层次也得以明确,即保护、尊重和救济义务。进而,通过国内法和国际法来规范跨国公司社会责任,也就具有明确的义务标准。为给中国企业在对外投资过程中承担社会责任提供更确定、有效的指引,可以将保护、尊重和救济义务纳入国内立法及双边投资协定中。

Although existing research has laid some theoretical foundations for establishing the social responsibility of transnational corporations,there are still some shortcomings.Analyzing the social responsibility of transnational corporations from the perspective of horizontal obligations can form a complementary theoretical framework for the establishment of the social responsibility of transnational corporations.Under the horizontal human rights obligations,the obligation level of the social responsibility of transnational corporations becomes clear,namely the responsibility to protect,respect and remedy.And to regulate the social responsibility of transnational corporations by the way of the domestic law and international law will thus have a specific obligation standard.In order to provide China's corporations a more concrete and effective guidance to shoulder social responsibilities in the process of foreign investment,the responsibility to protect,respect and remedy may be incorporated into the domestic legislation and bilateral investment agreements.
