论交强险中精神损害赔偿制度之完善

The Legislative Perfection of Compensation for Emotional Damages in Motor Vehicle Compulsory Insurance

自2006年中国施行交强险以来,有关交强险制度的各种争论就未曾停息,其中的精神损害赔偿制度一直是争论的热点之一。实践中存在着精神损害赔偿归责原则适用不统一、精神损害赔偿数额无通行确定方法、赋予当事人精神损害赔偿优先请求权之规定缺乏足够法理依据、精神损害理赔程序中负累重重等诸多不足,对交强险中精神损害赔偿制度的运行产生了负面影响。因此,结合法理和外国先进立法经验,通过明确精神损害赔偿归责原则及其数额计算方法、提高其赔偿限额、废除受害人优先选择权、简化赔偿程序等手段来完善交强险中精神损害赔偿制度就显得尤为必要。

Various debates about insurance system continues since its promulgation in2006.Mental damage compensation is one of the hot spots in the debate.There are many disadvantages in practice and have negative influence at the compensation for emotional damages in motor vehicle compulsory insurance,such as imputation principles of compensation for mental damage is not unified,how to decide on the amount of the compensation is controversial,gives the priority right of claim of compensation for mental injury lacks legal basis and procedures of mental injury claims become the burden in practice.Therefore,combining with other theories and foreign legislation experience,it's very important to clear determination of liability of compensation for mental distress damage and method to calculate the amount,cancel the victim priority right of claim of compensation for mental injury compensation when raise the liability limits,simplify the claims procedures.
