Reflection on Implantation of Traditional Ethics in Construction of Modern Marriage Law

现代意义上的《婚姻法》中婚姻制度本身属于家庭私域,引入"民法"之后,其中会牵涉到"财产的神圣不可侵犯"问题,即关于婚姻主体中的双方财产共有问题出现了矛盾,一个方面是婚后共同持有,另一个是"个人所有",因此从这个意义上看,有必要在其中引入"伦理引导",化解其中的矛盾。

The modern marriage system in Marriage Law itself belongs to the private family issues.The introduction t“o civil law”will have something to do with the issue o“f property is inviolable”.There has a problem of sharing property by both sides of marriage subjects.On the one hand,the property is held jointly by two sides;On the other hand,the property is belongs to individuals.Thus,to this point,it is necessary to resolve the conflict by introducing the“ethical guidance”.
