摘要 研究目的:通过端正对土地征收的认识,探索土地利用规划在征地过程中保障公共利益的作用,完善征地补偿标准。研究方法:文献资料法、规范分析和归纳法。研究结果:由于片面强调土地征收的低价补偿和强制特征,造成了对征地概念的异化。土地征收的公益性和补偿性是其与划拨用地、土地市场交易的共有特征,只有在损害公共利益时才不得不采用强制性。土地征收的公益性通过土地用途列举不易实现,只有通过科学合理地编制土地利用规划,全面落实公众参与,才可以既满足因公共利益需要而征地,又能合理分配土地增值收益。征地补偿价格应该按照房地产估价的原理与方法,依据征地机会成本损失,科学合理地进行定价。研究结论:端正对土地征收的看法,并结合土地利用规划合理确定征地范围,采取科学估价方法完善征地补偿标准。 The propose of this paper is to explore the roles of land use planning in safeguardingthe interest of the public in the process of land requisition and to perfect the compensationstandard of land requisition,through the correct understanding of land requisition.The method ofliterature is employed in the paper.Because the public welfare,compensation and mandatory of landrequisition are viewed in isolation,the concept of land requisition is alienated.By compilingscientifically the land use planning,it can not only meet the needs of land requisition for publicinterest and but allocate rationally the benefits of land value-added.The price of land requisitionshould be fixed reasonably in accordance with the principles and methods of real estate valuation.It is concluded that it is necessary to reform the land requisition system by correcting the viewsof land requisition,determining the scope of land requisition with the help of land use planning,and perfecting the standards of land requisition by adopting scientific valuation methods.
