摘要
2015年5月1日实施新修订的《行政诉讼法》,对房屋征收与补偿问题产生了重大的影响。新《行政诉讼法》加强了对国家公共利益的维护,同时强调对被征收人合法权益的保护。希望通过司法审判的独立性,最大限度地保护被征收人的合法权益。从根本上改变了人民法院处理房屋征收与补偿纠纷案件的状况,包括立案环节、审判方式、裁判结果、执行力度等多个方面。通过分析《房屋征收补偿协议》的合同目的,探讨当前签订《房屋征收补偿协议》过程中可能存在的问题。
On May1,2015,Administrative Procedure Law has taken effect.It has effect on theexpropriation and compensation of building.New Administrative Procedure Law strengthen the country’spublic interest,at the same time,emphasize the protection of the owner’s legitimate rights and theirinterests.Fundamentally changed the people’s rights of the building expropriation and compensationin judical process.Including registert,trial method,the results of the referee,enforcement,and manyother aspects.Based on the analysis of Building Compensation Agreement is purpose,dicuss the currentproblems.
