基层人大代表选举中正式代表候选人提名与确定

从实用程度和可操作性的角度来讲,基层人大选举制度(主要指运行)是有被改良的可能性,而基层人大选举正式代表候选人的提名与确定程序对于基层人大选举的重要性也不容小觑。从法律的规定抽象不具体,到选民提名权与知情权的实现程度较低,再到选举委员会这一选举执行机构的独立性严重缺失等一系列问题,都反映出基层人大选举正式代表候选人的提名与确认存在的现实问题较为突出。而要实现基层人大选举的民主,选出符合民意的人大代表,首要和迫切的是要解决以上三个方面的问题。同时,必要的立法建议,将使《选举法》的程序规定更加完善;推动预选作为确定基层人大代表候选人的必经途径将会消除选举外权力的不正当干预,使选举更代表民意;常设的具有独立性的基层人大选举委员会必将激发选民参与选举的热情。总之,通过选举来实现民主必然是自下而上的,即要变安排确认式的选举为积极参与式的选举。
