论我国特别没收程序利害关系人救济程序的不足及完善

On the Insufficiency and Perfection of the Special Forfeiture Procedure about the Stakeholders Relief Program

2012年我国修改的刑事诉讼法增加了违法所得没收特别程序,弥补了我国追逃追赃制度的不足,这有利于国际司法合作,但立法对特别没收程序中利害关系人救济程序的设置存在一定的不足,可能会侵犯公民合法财产所有权。通过分析特别没收程序救济程序的不足,找出其完善之路可以更好促进该程序在司法实践中的贯彻实施。

The special forfeiture procedure has been added in our criminal law in2012,which makes up forthe deficiencies of the system of recovered stolen goods and is beneficial to international judicial cooperation,but the legislation of relief procedures has certain shortcomings,which may infringe the civil rights ofproperty.Analyzing the insufficiency of the special forfeiture procedure can help people find better ways topromote the implementation of judicial practice in the program.
