网络仇恨言论治理的平台责任研究

Online Intermediary Liability for Online Hate Speech

中国目前正面临日益严重的仇恨言论问题,突出表现在网络仇恨言论十分泛滥。虽然中国目前并没有针对仇恨言论的专门性法律,但是相关规定散见于宪法、刑法、民法和行政法等法律法规。至于网络仇恨言论的治理,内容方面,需要明确网络仇恨言论的边界与范畴;责任方面,网络平台需要承担一些特殊侵权责任与注意义务。

China is now facing increasing hate speech,and online hate speech is very widespread.Although China does not currently have a statute on hate speech,the relevant provisions scatter in the Constitution,criminal law,civil law and administrative law and other laws and regulations.As for regulating the online hate speech,one hand,we need to clear the scope of online hate speech;On the other hand,the online platforms need to bear some special tort liabilities and attentionobligation.
