关于现阶段灵活就业人员职业伤害保障的思考

Thoughts on Occupational Injury Protection for Flexible Employment Personnel at the Present Stage

2017年4月,《国务院关于做好当前和今后一段时期就业创业工作的意见》明确提出要"探索适应灵活就业人员的失业、工伤保险保障方式,符合条件的可享受灵活就业、自主创业扶持政策"。关注灵活就业人员,保障其权利义务,已成为当今社会保障工作中的一个重要方向。对可按现有体制纳入工伤保险统筹管理的人员,通过政府强制、社会保险保障的办法,督促用人单位为职工参加工伤保险;对难以界定是否存在劳动关系的灵活就业人员,通过政府主导、商业保险运作的模式,建立起灵活就业人员职业伤害保障。

In April2017,the State Council put forward in the document that we should explore ways to adapt to the unemployment insurance system for fl exible employees.Paying attention to the fl exible employment personnel and protecting their rights and obligations has become an important direction in the social security work.For employees who can be integrated into the work injury insurance system according to the existing system,the employer shall be urged to participate in work-related injury insurance through the government's compulsory and social insurance guarantee measures.The fl exible employment personnel who are diffi cult to defi ne the existence of labor relations,through the mode of government led and commercial insurance operation,establish the occupational injury protection for the fl exible employment personnel.
