国家治理现代化进程中警察权的突破转型——基于《人民警察法》修订草案的思考

On the Transformation of Police Powers in the Modernization Process of National Governance——Based on the Thinking of Draft Amendment of People's Police Law of the People's Republic of China

我国迎来了改革开放的攻坚期,以国家治理体系和治理能力现代化为目标的新的治理理念成为当下国家建设发展的新目标。与此同时,2016年年底《人民警察法》修订草案在网络上公布并征求意见,这也为警察权的发展带来新的契机与挑战。草案内容的一个重大发展就是警察权的重构与现代化转型,而警察权的转型必须结合国家治理现代化对权力构建的应然要求,通过警察权的肢解与让渡廓清权力结构、厘定权力范围。同时,在警察权运行方式上也需从权力向度、权力主体及权力手段等多方面进行现代化转型,以此满足国家治理现代化对国家安全体系构建、社会治安治理体系与治理能力方面提出的新要求。

With our country entering the key period of reform and opening up,the new management ideawith the modernization of the national management system and management ability as the goal becomes thenew target of national construction and development.At the same time,the draft amendment of People’s PoliceLaw of the People’s Republic of China was issued online and asked for advice at the end of2016.It brings newopportunities and challenges for the development of police powers.Therefore,the transformation of police powersmust be combined with certain demands of the state management modernization of power construction and setthe power range through the dismemberment and transfer of the police power.At the same time,the operation ofpolice powers needs to be modernized and transformed from the direction of powers,the subject of powers andthe method of powers so as to meet the new needs of national security system construction,social public securitymanagement system and governance capability.
