知识产权客体扩张的检视与反思——兼论知识产权的立法体例

Review and Reflection on the Expansion of the Object of Intellectual Property——On the Legislative Model of Intellectual Property

知识产权的不断扩张,使得知识产权客体越发的呈现出多样化、不确定性的发展趋势。知识产权客体的非物质性特征,以及知识产权其他制度的相应消解和补足,也使得知识产权客体难以发挥出传统民法所寄托的权利客体价值。由此可见,在民法典编纂的语境下,需要进一步正视知识产权客体的特殊性、不确定性,以及其价值功能的缺失性。一方面,应在反思知识产权客体扩张的基础之上,于《民法总则》中采取权利列举的方式,而不宜继续沿用客体列举的路径,以便于更加周延的实现对知识产权权利体系的全面呈现;另一方面,应采取知识产权单行法的立法模式,进而在此基础之上,实现知识产权的单独"成典"。

With the gradual expansion of intellectual property,the object of intellectual property has become more andmore diversified and uncertain.What's more,the intangibility of the object,and the corresponding digestion and complementarity of other systems of intellectual property also make it difficult for the object of intellectual property to play the object value of the right which are valued by traditional civil law.Therefore,in the context of codification of civil law,it is necessary to further envisage the particularity,uncertainty and deficiency of value function of the object.On the one hand,we should be based on the refection of expansion of the object of intellectual property,and take the right-enumeration way rather than the objectenumeration way to thoroughly realize the full presentation of intellectual property rights system in the General Principles of Civil Law;on the other hand,we should take the legislative model of single law,and then based on this,make the intellectual property law“codified”alone.
