Discussion on the review obligation of maritime administrative licensing

文中通过分析"形式审查""实质审查""审慎审查"三种审查义务的基本内涵和适用现状,并结合现行海事法规体系的相关规定,论证海事行政机关在审查行政许可申请时,除法律、法规和规章明确规定应进行实质审查外,应履行形式审查义务,并对履行上述审查义务的注意事项进行阐述。

The paper analyzes the basic content and applicationof three categories of review obligations,i.e.form review,substantive review and cautious review.In view of therequirements of existing maritime laws and regulations,it arguesthat when conducting review during administrative permission,the maritime administration should perform the obligationsof form audit in addition to the substantive review explicitlystipulated by laws,regulations and rules.It also explains theprecautions for performing the above review obligations.
