摘要
2014年《行政诉讼法》修正案将诉讼时效延长至6个月,对于保障原告诉权具有积极意义,但给部分行政管理措施带来障碍,并影响行政效率。6个月较长时效、起诉期限未类型化以及错误将诉讼时效与行政管理措施挂钩是造成新诉讼时效难以平衡行政管理与权利救济的主要原因。建议修改行政管理领域法律法规,取消部分诉讼时效与管理措施的挂钩。基于行政诉讼的特殊性,应重新确立时效起算点,采用"短时效"主义与类型化相结合的方式,以期兼顾行政管理与个人权利保障,推进行政诉讼时效制度的完善。
The Administrative Procedure Law amended in2014has prolonged the timing when the plaintiff is allowed to sue the administrative agencies,and the duration has been extended to6months after the agency makes the decision.This amendment has a positive effect on protecting plaintiff’s right to sue,but creates new obstacles to several administrative activities,resulting in low administrative efficiency.The main reason why new timing can not make a balance between administration and right relief is that the duration of6months is relatively too long,not typed and even incorrectly attached to some administration activities.It is quite critical to remove the connection between administrative litigation timing and administrative activities by amending some laws and regulations.Based on particularities involved in both the administration and protection of individual rights,we suggest that administrative litigation should redefine the timing to start counting the duration,and adopt the short duration mode combined with classification,for the purpose of making the administrative litigation timing system completed perfectly.
