“南海仲裁案”一周年:历史回顾与现实思考

FIRST ANNIVERSARY OF "THE SOUTH CHINA SEA ARBITRATION CASE":A HISTORICAL REVIEW AND REALISTIC REFLECTION

2016年7月12日,在菲律宾政府单方面要求下,国际仲裁庭置《联合国海洋法公约》基本原则和国际政治常识之于不顾,悍然公布"裁决结果",引起国际舆论一片哗然。一年来,美菲等有关国家"仲裁结果"甫一出炉时的兴奋与高潮,在中国的战略定力面前,渐渐退去归于平静。特别是随着中菲关系的全面转圜,仲裁闹剧业已曲终人散,悄然落幕。审视"南海仲裁案"一周年的演进过程,其背后深层次的原因值得认真分析,其对南海的和平稳定、国际法的权威性和公正性、中国的和平崛起等产生的消极影响需要引起警惕。

On July12,2016,requested unilaterally by the Philippines government,the International Arbitration Tribunal disre-garded the basic principles of the United Nations Convention on the Law of the Sea and the international political common sense and flagrantly announced the"ruling",causing an international uproar.Over the last year,the excitement of the United States,the Philippines and other countries about"arbitration results",in the face of China's strategic concentration,gradually retreated.Especially with the comprehensive mediation of Sino-Philippine relations,the arbitration farce has come to an end.This paper examines the evolution of the case at its first anniversary and its deep-seated reasons are worthy of careful analysis.Its negative impact on the peace and stability of the South China Sea,the authoritative and impartiality of international law and the peaceful rise of China calls for our vigilance.
