《民办教育促进法实施条例》修订的立法建议——以分类管理为视角

Legislative Proposals for Revision of Implementation Regulations on the Private Education Promotion Law——From the Perspective of Classified Management

我国通过修改《民办教育促进法》确立了民办学校分类管理的法律制度。在分类管理背景下,为更好地贯彻实施《民办教育促进法》,必须对《民办教育促进法实施条例》做出相应修订。条例修订应当遵循回应立法修改、体现实施要求,落实分类管理、体现公益导向,坚持问题导向、体现促进精神等原则。结合新法修订与分类管理的新形势新要求,需要在条例调整对象与范围、民办学校设立、民办学校法人治理、民办学校扶持与监管、民办学校法律责任、现有民办学校过渡等方面对《实施条例》做出全面修订,以立法保障民办教育在新时期获得更加快速、健康、可持续的发展。

China has established the legal system of classified management of private schools by revising the Private Education Promotion Law.Under the background of classified management and to better implement the Private Education Promotion Law,it is necessary to revise the Implementation Regulations on the Private Education Promotion Law correspondingly.Implementation Regulations should follow the principles of responding to legislative changes,reflecting the implementation requirements,implementing the classified management,embodying the public interest orientation,insisting on the problem orientation,and reflecting the spirit of promoting etc.Combined with the new requirements under new situation on revision of the Private Education Promotion Law and classified management,it is of great necessity to make a comprehensive revision to the Implementation Regulations on the Private Education Promotion Law as the following aspects:adjusting the object and scope of the regulations,the establishment of private schools,corporate governance of private school,support and supervision on private school,legal responsibility of private school,transition approach for the existing private schools etc.With the way of legislation,ensure that private education obtains more rapid,healthy and sustainable development in the new era.
