摘要
海上货物运输中,如果托运人或收货人不及时支付运费、滞港费等费用进而导致承运人行使留置权的案例屡见不鲜。对我国2007—2015年间发生的滞港费承担的法律实务案例进行分析,从承运人存在过错、船代/货代存在过错、非因托运人过错以及滞港费承担的时间和价值范围等方面,对国际私法实务中不同情形下国际海运滞港费最终由谁承担的问题进行了探讨,并提出了建设性建议,以期为我国进出口企业在处理海运滞港费问题的实践中提供法律参考依据。
In the carriage of goods by sea,it is not uncommon that the carrier has to excise lien right if shipper or consignee cannot pay the freight and demurrage on time.Based on the analysis of legal cases in China on paying demurrage from2007to2015,from the aspects of the carrier's faults,shipping agency's/forwarder's faults,and faults not caused by shipper and range of time and value of demurrage paying,this paper firstly discusses that who should pay the demurrage ultimately on different situations of international shipping,then put forward some constructive suggestions,in order to provide legal reference for the import and export enterprises dealing with the demurrage issues of international shipping.
