生态红线内矿业权退出的问题及对策

Problems and Countermeasures of Mineral Right Withdrawal within Ecological Red Line

生态红线是国家为了保护区域之内的生态环境而划定的需实施特殊保护的区域,生态红线随着时间、政策和管理目标变化而发生变化,难免会与既存的矿业权发生重叠性冲突。生态红线内矿业权退出面临违规状况不清楚、权利义务不清晰、法律规定不清晰、法律责任划分不清晰的困难。完善生态红线内矿业权退出机制建议:(1)摸清生态红线内矿业权存在的底数;(2)建立梯次退出机制;(3)划定权利义务关系;(4)明确退出补偿标准;(5)规定生态补偿标准;(6)立体化监督与公众参与。

Ecological red line defines special reserves that the central government delineates to protect environment within it.Since ecological red line changed with time,policies and management targets,it is inevitable that the line collides with existing mineral rights.Problems of mineral right withdrawal within ecological red line faced by management departments are unclear situation of illegal mineral rights within ecological red line,indistinction of rights and obligation,obscureness of legal provisions and unclear division of legal liability.Therefore,here we propose following suggestions to perfect mineral right withdrawal within ecological red line:(l)finding out total amount of mineral rights within ecological red line;(2)establishing echeloned withdrawal system;(3)designating rights and obligations;(4)clarifying compensation standard of withdraw mineral right;(5)specifying ecological compensation standard;(6)forming a three-dimensional supervision and involving public participating.
