从罗马法上的“丧廉耻”制度审视政府采购失信惩戒制度

The Punishment on Government Procurement Dishonesty:Based on the “Infamia” in Roman Law

政府采购失信惩戒是近年来随着社会信用体系发展而提出的新概念,系指限制失信供应商、采购代理机构及评审专家参与政府采购活动。在罗马法上,与之相类似的是"丧廉耻"制度,该制度将违反公序良俗的个体之市民权中的公权予以剥夺。虽世殊事异,但"丧廉耻"制度的核心价值依然可与现代法制相兼容,并且与政府采购失信惩戒制度存有共通之处,两者在宗旨、动因、方法、后果等方面具有一致性。以"丧廉耻"制度为鉴,需要从明确商誉权的人格权地位、引入公司人格否认制度、提高信用管理水平、建立失信主体救济机制等方面入手,进一步完善政府采购失信惩戒制度。

Punishment on government procurement dishonesty is a new concept,which was put forward with the development of the social credit system in recent years.It means dishonest suppliers,procuring intermediaries and evaluation experts are restricted from participating government procurement activities.This is very similar to“infamia”in Roman law,a system that deprives the public rights of those individuals who violate public order and good morals.Although time has changed and things are different,the core value of“infamia”is compatible with modern legal system,and is interrelated with the system of punishment on government procurement dishonesty.These two systems are identical in purpose,motivation,methods and results.By using“infamia”for reference,we’ll be able to find out ways to further improve the system of punishment on government procurement dishonesty,for example,by determining the personality status of goodwill right,introducing corporation personality negation system,improving credit management capabilities,and establishing remedy mechanism for dishonesty,etc.
