深度链接行为入罪化的困境与出路

The Dilemma and Countermeasures of Criminalization of Deep Linking Behavior

深度链接行为是互联网上侵犯著作权的新兴方式,使得访问者可以不经页面跳转,直接访问他人网站的信息资源,损害了版权人的合法权益,破坏了稳定有序的互联网环境,具有严重的法益侵害性。解决深度链接行为入罪化存在理论困境,可采用两种较为可行的司法路径:一是适用"帮助行为正犯化"以帮助信息网络犯罪活动罪入罪,二是适用"行为共同说"以侵犯著作权罪入罪。

Deep linking behavior is a new way of copyright infringement behavior on the Internet,so that visitors can access the information resources of other websites directly without web pages jumping.Deep linking behavior damages the legitimate interests of the copyright owner,destroys the stable and orderly environment of the Internet,and has serious legal interest infringement and social harmfulness.There is a theoretical dilemma in criminalization of deep linking behavior.In this paper,two feasible judicial paths are put forward:one is to apply“helping behavior criminalization”to criminalize deep linking behavior by the Crime of Helping Information Network Crime,the second is to apply“theory of behavior common”to criminalize deep linking behavior by the Crime of Infringing Copyright.
