大学生的网瘾迷失:高校管理的法律职责再探讨

高校中大学生网络成瘾的问题已相当严重,在探究大学生网瘾成因时应该重视高校环境与学生网瘾的相互影响关系,在其中找到问题的症结之处,以期利用高校职责的行使消除相应网瘾诱因。高校作为提供公共教育服务的组织,与大学生之间形成了公法和私法上的双重法律关系,因此高校管理的职责不仅来源于行政法律法规,也来源于民事教育服务合同。高校应履行其职责,针对网瘾问题采取预防与矫治相结合的措施。高校管理中应当遵循权利平衡、以人为本的理念,在高校治理法治化的进程中尽早形成高校与大学生之间良好的互动模式和管理秩序。

There is a generally explosion that undergraduates are addicted in internet in college. When probing into the reasons of undergraduates with internet addiction, we shall pay attention to the interacted relationship between university environment and undergraduates with internet addiction. And then we can find out the striking points of problem from it to expect that we can take advantage of the use of university duty to eliminate relevant inducement of internet addiction.As an organization providing public education service, higher institutes form a dual legal relation of public law and private law with undergraduates. Therefore, the duty of university managements not only derives from administrative rules and regulations but also comes from civil education service contract. Higher institutes should perform their responsibilities and take measures of the combination of prevention and correction in allusion to internet addiction. In the institution managements, we shall follow principles of rights equilibrium and people oriented so as to expect that excellent interactive model and administration order between higher institutes and undergraduates can be formed as soon as possible in the process of legislation of university management.
