地方法治建设的困境与出路--以邯郸招商乌龙事件为例

The Predicament and the Way-out of the Construction of the Local Rule of Law——Taking the Case of Handan Merchants Misguided Affairs as An Example

作为地方公共利益代表的地方政府在招商引资过程中被骗,是对政府公信力的巨大损害,究其原因在于经济利益和政绩的驱动,以及公权力缺乏监督和控制。地方政府招商引资被骗凸显出地方法治建设的困境,主要体现在地方政府法治思维欠缺、地方法治建设没有严格落实到位、地方政府权力失去监督和制约。为此,地方法治建设不能仅仅停留在口号上,要真正付诸实施,做到自我革命、自我束缚;要改变现有的政绩考核机制,摆脱"以GDP论英雄"的观念,树立科学的政绩观;健全横向责任追究机制,加大对主导招商引资官员的问责力度;加强法治社会建设,发展和壮大当地社会组织,提高民众法治素质,监督地方政府公权力的行使。

As a representative ol the local public interest,the local government is deceived in the process ol attracting foreign investment,which is a great damage to the credibility ol the government.The reason is the driving lorce ol economic interests and achievements,and the lack ol supervision and control ol public power.The dilemma ol attracting investment lrom local governments shows the dilemma ol local rule ol law construction,which is mainly reflected in the lack ol local government,s rule ol law thinking,and the construction ol local rule ol law is not strictly implemented,and the power ol local governments is out ol surveillance and restriction.To this end,construction ol local rule ol law is not just stay in the slogan on the construction ol the rule ol law,but also really implemented,do sell revolution and sell restraint,change the existing performance evaluation mechanism,get rid ol the"GDP heroes"concept,establish a scientific view ol achievements,im-prove the lateral accountability mechanism,increase the leading investment accountability ellorts to strengthen the construction ol the rule ol law,develop and grow local social organizations,improve the quality ol public law,and exercise the supervision ol local government authority.
