关于建设工程中黑白合同的探析

目前,我国立法中并无"黑白合同"这一术语,它只是对一种社会现象的概括,其实质是一种交易行为。建设工程领域中"黑白合同"的出现是合同双方经济博弈的结果,也是市场经济发展过程中建筑市场逐步走向完善的结果。论文就建设工程中的"黑白合同"问题进行探析,简要分析其基本特征、存在的不同情形及在不同情形下的法律效力和个人的一些思考。

At present,there is no"black-white contract"term in our country's legislation.It is only a summary of a social phenomenon,and its essence is a kind of transaction behavior.The emergence of"black-white contract"in the field of construction engineering is the result of economic competition between the two parties.It is also the result of the gradual improvement of the construction market in the development of market economy.This paper analyzes the"black-white contract"in the construction engineering,and briefly analyzes its basic characteristics and different situations,and in different situations of legal effect,and personal thinking.
