从管理到共治:航道法的理念跃升与制度完善

From the Management to the Cohabitation:Idea Advance and System Perfection of the Waterway Law

《航道法》的颁行成为航道事业发展的制度支撑,为航道法治迈出了坚实的一步,回应了我国原有航道管理与现代航道事业不适应的问题。为建构航道事业中的共治体系以及与国家治理能力的现代化相匹配,航道立法的理念由原有的管理到共治的跃升,在相关制度的设计上也围绕理念的改变而逐步从横向航道治理权的优化、航道治理权配置的建构、航道治理权的多元性三方面逐步进行完善。

The enactment of the"Waterway Law"has become the institutional support of the waterway development and has taken a solid step for the rule of Waterway,responding to the incompatibility between the original waterway management and modern waterway.To construct the co-governance system and match the modernized country administration,the concept of waterway legislation has advanced from the original waterway management to co-governance.Centered on the change of concept,the design of related institution has also improved gradually in three aspects:the optimization of horizontal waterway governance rights,the construction of waterway management right allocation,and the diversity of waterway governance rights.
