摘要
发源于哈佛大学法学院的案例教学法以其自身突出的优点成为美国法律教育的一大教学特色。这一教学方法符合法律教育的内在品格和高职人才培养的需求,在我国推行具备较强的现实意义。但是,部分教师在实际运用过程中存在认知和操作上的误区,影响了案例教学法的效用。有必要加以澄清,并从案例教材、教学方法、评价体系、外部保障入手提升案例教学法的实效,促进高职人才培养目标的实现。
Case method teaching,originated at Harvard Law School,has become a major teaching feature of legal education in the United States with its own distinct advantages.In China,this teaching method can be practically adopted since it meets intrinsic characters of legal education and the goal of higher vocational talents training.However,currently it is not efficient due to a lack of understanding and experience on the part of certain instructors.In order to achieve the goal of higher vocational talents training,it is necessary to clarify misunderstandings and enhance case method teaching through the use of casebooks,teaching methods,evaluating system and external support.
