原制造商与第三方再制造商知识产权共享路径研究--再制造产业有序快速发展视角

The Research on the Unified Use of Intellectual Property between the Original Manufacturers and the Third Party Manufacturers——Based on the View of the Orderly and Rapid Development of Remanufacturing Industry

研究原制造商和第三方再制造商知识产权共享路径,协调双方知识产权关系,推动再制造产业有序快速发展。从经济和法律两个角度研究废旧产品中含有的知识产权归属问题,理顺原制造商和再制造商的知识产权关系;构建原制造商对再制造商进行知识产权许可的博弈模型,研究如何促进原制造商同意对再制造商进行知识产权许可和吸引再制造商从事再制造行为;构建再制造商向原制造商缴纳知识产权使用费的博弈模型,研究如何促进再制造商同意向原制造商缴纳知识产权使用费。最后,提出了原制造商和再制造商之间的知识产权共享路径,制定了动态的知识产权保护力度原则,为双方实现正向协同效应提供指导,推动再制造产业有序快速发展。

The study on the research on the unified use of intellectual property between the original manufacturers and third party manufacturers,promoting remanufacturing industry rapid orderly.The paper make research on the use system of intellectual property in remanufacturing industry:from the perspective of economy and law,the ownership of intellectual property in wasted products is analyzed,and the game models are respectively constructed to discuss how to promote the manufactures licenses the intellectual property to the remanufacturers and how to promote remanufacturers to pay for the use of the intellectual property,thus constructing shared path of intellectual property by remanufacturer and original manufacturer.The paper puts forward the under unified use of intellectual property between the original manufacturers and third party manufacturers,establishes the principle of dynamic protection of intellectual property rights,as both sides can provide the theory and method to guide positive synergies,lay theoretic foundation for orderly and rapidly development of remanufacturing industry.
