《新闻出版法》:价值、原则与内容

On the Importance,Content and Principle of Press and Publication Law

国务院颁布的《出版管理条例》是我国目前关于新闻出版法制的基本规范,但它只是一个行政法规。出版自由是宪法规定的一项基本自由,而我国却没有专门的《新闻出版法》来对之加以调整和保护。从建设文化强国的角度来看,我国应结合多年调整出版行业的实践,吸收现代新闻法制经验,以出版自由和"事后追惩"为原则,制定我国的《新闻出版法》。

In present China,the fundamental norm of press and publication is the Regulation of Publication,which is administrative regulation.Liberty of the press is the important basic constitutional right,but there is no law to regulate and protect it in China.From the sight of establishing a strong cultural nation,according to the practice and principles of modern press and publication law in other countries,China should make press and publication law,which is based on the liberty of press and the principle of“punishment after wrongdoing.”
