Thinking of the Enforcement of China's Constitution in Terms of Political Approach and Complete System

宪法实施是宪法学界研究并关注的核心问题,对宪法实施的概念与内涵、应该如何实施宪法、及在何种程度上宪法得以实施等,仍然存在诸多争论。我们认为应根据中国的国家制度,从宪法的文本出发,对宪法实施进行回顾、整理和分析,对宪法的政治性与实施特征进行探讨,方可完善宪法实施的审查机制,以回答对中国宪法实施及其前景的怀疑。

The enforcement of the constitution is the core issue in the field of constitutional study.However,there are many disputes in such problems as the concept and denotation of the enforcement,the way of the enforcement,and the extent to enforce constitution.Reviewing and summarizing the situation and routes of the enforcement of China's constitution,this paper tries to set up a theoretical framework with Chinese characteristics in order to dispel doubts about the enforcement and prospects of China's constitution.
