民航机场净空保护的法律问题与对策——以无人机非法干扰为视角

Law Problem and Countermeasure of Civil Aviation Airport Clearance Protection—— UAV Unlawful Interference as Angle of View

无人机等飞行器在社会活动、行业应用方面越来越频繁,特别是一些便携式轻型无人机,更是受到了大众的喜爱,在操控过程中不分区域范围,尤其是在民用航空机场净空保护区域范围内飞行,不仅对航空旅客人身财产安全造成潜在威胁,更严重扰乱航空运输的正常秩序。本文以机场净空保护区为焦点,分析我国民航机场净空保护区飞行器干扰航班事件、相关国内法律规范以及处置中出现的问题,提出应对无人机干扰机场净空区事件的法律建议。

UAV and other aircraft have been used more and more frequently in social activities and industry application,and particularly some portable light UAV have been loved by people not considering regional range during operating UAV.Letting UAV fly within the range of civil aviation airport clearance protection will not only threaten aviation passengers’personal and property security,but also disorder the normal air transport.In this thesis,the airport clearance protection area is set as the focus,to analyze issues of the aircraft disturbing flights in China’s civil aviation airport clearance protection areas,relevant domestic law regulations and problems in disposing,to raise law suggestions for issues of UAV disturbing airport clearance protection areas.
