生态文明试验区的执法困境及创新机制探析

Research on the law enforcement predicament and innovation mechanism of ecological civilization pilot zone

党的十八大把生态文明建设作为国家全面深化改革,全面建设社会主义国家的重要一环,首次把生态文明建设摆在总体布局的战略地位,为我国环境行政管理注入了"绿色基因"。自2016年8月开始,中央层面综合考虑各方面因素,首批选择生态基础较好、资源环境承载能力较强的福建省、江西省和贵州省作为试验区,提出在试验区内创新环保各项制度,为全国生态文明建设提供切实可行的范例,为试验区大力开展环保执法,创新环保执法机制提供了重要契机。现阶段我国环保执法问题主要体现在环保行政主管部门本身、执法部门与相对人之间和环保执法监督三方面。为此,我们应创新治理制度,为生态文明建设环保执法提供一套有效、合作、联动的执法方式。

Since the 18th CPC National Congress,the construction of ecological civilization has been regarded as an important part of comprehensively deepening reform and building a socialist country in an all-round way,For the first time,the construction of ecological civilization has been placed in a strategic position in the overall layout,which has infused“green gene”into the environmental administration in China,Since August 2016,at the central level,“taking into account factors such as the practical basis,regional differences and stage of development of existing ecological civilization reforms in various places,the first batch of eco-bases have been selected with better ecological and environmental carrying capacity as pilot zones,such as Fujian Province,Jiangxi Province and Guizhou Province”,proposed to innovate various systems of environmental protection in the pilot zone and lay a practical foundation for the construction of ecological civilization throughout the country,which provide an important opportunity for vigorous environmental law enforcement and innovative environmental law enforcement mechanism in the pilot zone,At this stage,the issue of China’s environmental law enforcement is mainly reflected in the environmental administrative department itself,the law enforcement agencies and relatives and environmental law enforcement supervision,we should innovate governance system to provide an effective,cooperative and linkage law enforcement for the construction of ecological civilization and environmental law enforcement,
