我国环境法学研究十年(2008—2017年):热议题与冷思考

Research on Environmental Law in China in the Past Ten Years(2008-2017):Hot Issues and Rational Reflection

近十年来,我国环境法学研究聚焦于生态文明法治的环境法学专门研究与法学跨学科研究、《环境保护法》修订的诸多环境立法问题两大方面,进一步可以细化为聚焦生态文明环境法治建设、生态环境损害赔偿、生态补偿以及《环境保护法》立法目的、环境行政管制与环境行政法律责任、按日连续处罚、公众参与和信息公开、政府环境责任、《环境保护税法》的立法、环境司法专门化、环境公益诉讼、环境保护党政同责与督察制度等热点问题的研究。在环境法学研究学术繁荣、热点纷呈的背后,仍需要环境法学界在环境法学研究的本体与方法之间、舶来与本土之间、环境法制和法治之间的冷静思考。未来的环境法学研究,既要不断促进学科自身的本体和研究方法的成熟,又要正确处理好基于生态文明建设实践的本土化研究与学习、借鉴国外环境法治先进理论和经验的关系,推动我国社会主义环境法制向环境法治的不断发展和进步。

Since last decade,the research of environmental law in China has been focusing on the following two aspects:special research of environmental law from the perspective of ecological civilization rule of law and interdisciplinary research in the science of law;and the numerous environmental legislation issues around the revise of Environmental Protection Act,which could be further refined as the research of hot issues focusing on the formulation of ecological civilization law,compensation for damages of ecological environment,eco-compensation and the legislative intent of Environmental Protection Act,environmental administrative control and liability,continuous punishment per diem,public participation and information disclosure,government′s environmental responsibility,legislation of Environmental Protection Tax Act,specialization of environmental judicature,environmental commonweal litigation,the shared responsibility of the party and the government in protecting environment and supervision system,etc.However,behind the academic prosperity and hot spots′blossom,there are still problems need rational reflection in the circle of environmental law,including noumenon and methodology,exoticness and nativeness,environmental law system and environmental rule of law in environmental law research.The future research of environmental law should not only promote the maturity of noumenon and methodology of the discipline itself,but handle the relationship between indigenous research on the basis of ecological civilization formulation practice and research and reference of advanced theory and practice of foreign environmental rule of law,thus promoting the continuous development and progress of socialistic environmental law system to environmental rule of law in China.
