基于电子文件管理视角的互联网电子证据保全研究

Research on the Electronic Evidence Preservation on the Internet:From the Perspective of Electronic Records Management

互联网环境中的电子文件作为公众在网络空间中行为的原始记录,可以成为公众维护自身合法权益的重要凭证,但其证据资格与证明力的保障需要依托有效的电子证据保全。论文立足电子文件管理视角,对互联网电子证据保全开展跨学科研究,辨析从电子文件到电子证据的概念变化,指出在互联网环境中应该借鉴电子文件管理的前端控制与全程管理理念,突破现有电子证据单一要素保全的局限,开展对互联网环境中电子证据的预先保全与实时保全。

Electronic records produced on the Internet Service Platform is the original record of the online action,which could be the important evidence for the public right or interest.Their proof qualification relies on the preservation.From the perspective of electronic records management,this article analyzes the difference between Electronic Records and Electronic Evidence.It is advocated to carry out the advance preservation and real-time preservation for the electronic evidence in the internet,following the basic principles of front-end control and whole-process management for electronic records.
