监察体制改革中检察权司法属性之回归

Return to the Jurisdiction of Prosecutorial Power in National Supervision System Reform

监察体制改革试点中,检察院职务犯罪侦查权的转隶破解了长期以来检察机关属性定位的困扰。首先,检察院行使自侦权具有行政权的主动性,与司法权的被动性相悖;其次,检察院自侦权使得检察院内部监督"自侦自诉",导致公诉部门监督不力,影响其法律监督的效能。因此,检察权回归司法属性能避免检察院既侦查又监督的缺陷。监察委员会对职务犯罪的侦查有利于实现统一的反腐机制和"监察百官"式的监督。同时,应完善检察院对职务犯罪案件的侦查监督和公诉工作。

In national supervision system reform,investigation power no longer belongs to the procuratorate,which can clarify the definition of prosecutorial power.Firstly,the investigation power has the feature of executive power but not judicial power.Secondly,the procuratorate has both the investigation power and prosecution power,which cause supervision problems.Thus,as the legal supervision organs,the procuratorate should concentrate on supervision power.Only in this way can we build up anti-corruption system and supervision system.At the same time,the procuratorate should enhance the supervision power of investigation and prosecution.
