固体废弃物不同危害模式下的立法治理研究

Legislation Research on Multi-hazard Model of Solid Wastes

我国固体废弃物污染事件频现,相应的治理机制急需完善。"深圳光明滑坡"事件的出现不仅体现了固体废弃物危害的复杂性,也再一次引起了学界对固体废弃物致损的高度重视。文章以固体废弃物危害模式为切入点,结合其他各国立法与实践经验,从"固体废弃物"之概念内涵、相关立法之目的、责任主体的范围、危害产生后的治理标准等若干层面展开论述,分析、探讨我国固体废弃物治理的相关立法规范,并针对现存问题从法律角度给出相应的治理建议。

China’s solid waste pollution incidents occur frequently,the corresponding governance mechanism needs to be improved.The“Guang-Ming,Shenzhen landslide”incidents not only reflect the complexity of solid waste hazards,but also once again draw attention of the academic circle to the hazards of solid wastes.This paper aims to take the solid waste hazard model as the breakthrough point,combined with other countries’legislative and practical experience,analyzes and discusses the relevant legislation of solid waste management in China.It mainly expounds the concept connotation of“solid waste”,the purpose of relevant legislation,the scope of subjects of liabilities,the governance standard after the occurrence of hazards,and the corresponding governance suggestions from the legal point of view.
