受贿犯罪运行规律、内在逻辑与有效治理--基于C市基层法院30份刑事判决书的分析

通过统计发现,法释[2016]9号实施以来,受贿犯罪人呈现出性别比例失衡,年龄分布集中,高智商化等特性。在不法方面,工程项目等经济性较强的节点成为催生受贿的主要来源,犯罪数额以较大、巨大为主,但受贿行为本身的成本巨大。结构化理论中的规则与资源能够对受贿行为产生一定的解释力,而行为主体经济活动范围的有效界定、组织行为过程的公开化、自由裁量权的控制、刑量配置的公正性以及转变治理观念治理受贿犯罪的有效策略。

According to the statistic,the author found people who have taken bribes have shown a gender ratio imbalance,age distribution concentration and high intelligence quotient since the implementation of the judicial interpretation(2016.NO.9).On the illegal aspects,the period with stronger economy feature,such as engineering projects,became the main source of bribery with huge crime amount,while the cost of the bribery itself is tremendous.Rules and resources of Structured Theory can explain the cause of bribery to some extent.Bribery can be controlled effectively by defining the scope of economic activity,publicizing the process of organizational behavior,controlling discretion,setting the sentences configuration impartiality and changing management concept.
